Mediation Philosophy

Mediation is a party driven process with the express goal of assisting the parties in resolving, or, at a minimum, narrowing their disputed issues so that settlement, on terms the parties decide, can more easily occur. Among other things, mediation provides an opportunity to gather relevant information, usually at an early stage of the proceeding, which will facilitate settlement, thus avoiding the uncertainties, rigors, expense, and unavoidable stress that is inevitably caused by protracted litigation. While most parties prefer to have their cases evaluated by the mediator, the parties want to do so in a non threatening atmosphere that is otherwise conducive to both listening and being heard.
